Service Level Agreement

Standards and practices

All clients are subject to the following terms of service which ensure our responsibility to protect each client and to provide the best services available:

SMS and Text Messaging Terms

8.1

If you opt in to receive text messages from Web Host Pro, you consent to receive recurring SMS messages related to your account, support requests, service notifications, and other communications you requested. Consent is not a condition of purchasing any goods or services.

8.2

Message frequency varies. Message and data rates may apply. Your carrier’s terms and privacy policy apply. Web Host Pro is not responsible for delayed or undelivered messages caused by your carrier or other service providers.

8.3

To stop receiving text messages, reply STOP to any message. After you send STOP, you may receive one confirmation message and no further messages unless you opt in again. Reply HELP for assistance or contact Web Host Pro support.

8.4

Our SMS and text-messaging privacy practices explain how mobile numbers, consent records, and messaging information are handled. These terms are also available through our terms of service.

Indemnification Policy

1.1

You agree to use all Web Host Pro services and facilities at your own risk. Web Host Pro specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall Web Host Pro be liable for any loss, or loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages.

1.2

Customer agrees that it shall defend, indemnify, save, and hold Web Host Pro harmless from any demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Web Host Pro, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify, and hold harmless Web Host Pro against liabilities arising out of Any injury to person or property caused by any products sold or otherwise distributed in connection with Web Host Pro's server.

1.3

We respect our customers' freedom to publish and operate lawful websites. We may become involved when reasonably necessary to comply with applicable law or a valid legal order, respond to a supported claim of third-party rights, or address a specific risk to our network or other customers. We will consider the available facts, explain the concern, and give you a reasonable opportunity to respond or correct it whenever practical.

1.4

One support ticket per issue helps us keep the full conversation together and respond efficiently. If duplicate tickets are opened, we may merge them. We ask customers and staff to communicate respectfully. If a conversation becomes threatening or abusive, we will normally explain the problem and allow time to reset the conversation. We may pause a particular support thread if harmful conduct continues, but we will not suspend a hosting account merely because of a support disagreement.

Billing & Services

2.1

At this time we bill monthly, quarterly, semi-annually, and annually, depending upon the plan. All web hosting account plans include a 45-day money-back guarantee. VPS and Dedicated Server plans include a 15-day money-back guarantee. Third-party products and services, including cPanel licenses, search engine submission, advanced SSL certificates, and domain name registration, are nonrefundable. Any completed custom work will be deducted from the eligible refund at the applicable administrative rate. If the custom-service charges exceed the eligible service refund, no additional payment will be required.

2.2

Free domain registration requires annual or longer payment plans and renews at the normal domain registration rate after a year.

2.3

If a chargeback is opened for a payment to Web Host Pro, we will contact you so we can understand and resolve the billing concern. If the chargeback remains open and no other arrangement is made, the affected service may be paused after reasonable notice while the dispute is reviewed. We will work with you to restore service once the billing issue is resolved.

2.4

We accept Visa, Master Card, American Express, Discover Card, and PayPal. For web hosting plans, we will not set up your account without payment (no trial periods). There are no long-term commitments. Your service renews automatically at the end of each billing period unless you let us know you would like to make a change or cancel.

2.5

All Web Hosting account plans, including cPanel, reseller, WordPress, ecommerce, and Website Builder hosting, include a no-questions-asked 45-day money-back guarantee. If you are not satisfied with your service and cancel within 45 days of activation, you will receive a refund of the eligible hosting-plan charge minus additional work, custom services, licenses, setup fees, or completed website transfers. Domain registration, web design, control-panel licenses, advanced backups, application licenses such as Softaculous, SEO, and other add-ons are not included. Refunds are normally unavailable after 45 days unless both parties agree otherwise. All cancellation requests must be received through a support ticket and include owner verification. You will receive a confirmation email when the cancellation is processed.

All VPS and Dedicated Server plans include a no-questions-asked 15-day money-back guarantee. If you are not satisfied with your service and cancel within 15 days of activation, you will receive a refund of the eligible server-plan charge minus additional work, custom services, licenses, setup fees, or completed website transfers. Domain registration, web design, control-panel licenses, advanced backups, application licenses such as Softaculous, SEO, and other add-ons are not included. Refunds are normally unavailable after 15 days unless both parties agree otherwise. All cancellation requests must be received through a support ticket and include owner verification. You will receive a confirmation email when the cancellation is processed.

2.6

Our servers are intended for permission-based email. We do not allow unsolicited bulk email or websites used to support unlawful spam campaigns. Because legitimate messages can sometimes be reported by mistake, we review the available evidence and contact the customer before taking action whenever practical. For an active large-scale campaign that is harming delivery or network reputation, we may temporarily restrict the affected mail service and will explain the issue as promptly as practical. Anti-spam systems operate on shared servers and network routes, and outside providers may also block IP addresses associated with unwanted mail. More Information on SPAM free servers. High-volume email can be filtered even when recipients have opted in. If you plan to send more than 1,000 messages a day, we recommend using a third party email system like these. This helps protect normal website and mailbox delivery for you and other customers.

Late Payments

3.1

All web hosting and reseller accounts are billed according to the dates they were first activated on. If payment is still outstanding 5 days after the due date, we will send reminders and invite you to contact us. If we do not hear from you or arrange additional time, the service may be temporarily paused until payment is made. VPS and Dedicated Server arrangements may have different timelines stated in the applicable plan or agreement. Dedicated Server billing issues are handled manually with direct communication.

3.2

If a balance remains unpaid for 20 days after service is paused and we have not agreed on another arrangement, the service may be closed and its data scheduled for removal. We will send regular reminders beforehand. Please contact us if you need more time; we are happy to review reasonable requests case by case. You should also keep an independent backup of important data.

Acceptable Use Policy

4.1

All services provided by Web Host Pro may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of applicable law is prohibited. Customers are responsible for ensuring that their content and activity are lawful and that they have the rights needed to use and distribute their material.

4.2

The subscriber agrees to indemnify and hold harmless Web Host Pro and its employees from any claims resulting from the use of the service that damages the subscriber or any other party.

4.3

We are a hosting provider, not a regulator of lawful internet content. When we receive a credible report of unlawful activity, we will review the available facts, contact the customer, explain the concern, and provide a reasonable opportunity to respond or correct it whenever practical. If active unlawful conduct or an imminent threat requires urgent action, we may apply the narrowest temporary restriction reasonably needed and will notify the customer as promptly as practical.

4.4

We do not impose content restrictions merely because we dislike or disagree with lawful material. If content and activity are legal, customers are generally free to use their hosting for them. Content or activity that is illegal under applicable law is not permitted.

4.5

Subscriber acknowledges that the service provided is of such a nature that service can be interrupted for many reasons other than the negligence of the company and that damages resulting from any interruption of service are difficult to ascertain. Therefore, the subscriber agrees that the company shall not be liable for any damages arising from such causes beyond the direct and exclusive control of the company.

4.6

Subscriber further acknowledges that the company's liability for its negligence may not in any event exceed an amount equivalent to charges payable by the subscriber for services during the period damages occurred. In no event shall the company be liable for any special or consequential damages, loss, or injury.

4.7

Unlawful activity, including fraud, trafficking, unlawful harassment, unauthorized access, or knowing infringement of intellectual-property rights, is not permitted on our network. Good-faith disputes and supported legal notices will be reviewed fairly rather than decided by preference alone.

4.8

Lawful security research, software development, technical discussion, chat services, and downloads are allowed. Using our services for unauthorized access, malware distribution, piracy, or other illegal activity is not allowed. You must own or have permission to distribute hosted software, audio, video, and other protected material. Any refund eligibility will follow the standard refund terms and the circumstances of the matter.

4.9

Flexible Resources and Practical Support

Each hosting plan includes the features shown on its plan page and order summary. Shared-hosting CPU, memory, and other server capacity are managed dynamically and are not subject to a separate fixed allocation in these terms unless a plan expressly states one. We ask customers to use shared resources thoughtfully, but we understand that traffic, maintenance, and application workloads naturally change over time.

Web hosting accounts are backed up daily using local and remote backup systems; however, while we take every precaution, we cannot guarantee backup availability at all times. It is essential to maintain your own backups as well. VPS and Dedicated Server backups are not enabled or scheduled without customer approval. Customers should contact support to approve a backup schedule or implement an independent backup solution.

If sustained activity materially affects server stability or other customers, we will contact you and work with you on practical options such as optimization, configuration changes, or a more suitable plan. Any temporary technical restriction will be limited to what is reasonably needed while we work toward a solution.

WordPress Freedom

There is no separate WordPress installation cap in these terms. You may install WordPress across the websites included with your plan, subject only to the plan's published website, storage, and other included features. If a site needs unusual capacity, we will help explore optimization or plan options rather than applying an arbitrary installation limit.

If you have any questions or need assistance optimizing your website, our support team is always happy to help!

Limitation of Liability

5.1

Web Host Pro shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from our servers going offline or being unavailable for any reason whatsoever.

5.2

Furthermore, Web Host Pro shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from any of our servers. Any liability is subject to the limitations described in section 4.6.

Disclaimer

6.1

Web Host Pro cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits that a client would have gained if their site was functioning.

6.2

Certain services provided by Web Host Pro are resold. Thus, certain equipment, routing, software, and programming used by Web Host Pro are not directly owned or written by Web Host Pro. Moreover, Web Host Pro holds no responsibility for the use of our client's accounts.

6.3

If these terms are not followed, we will normally explain the concern and provide a reasonable opportunity to correct it. Service restrictions are a last resort and will be proportionate to the issue, except where urgent action is required by law or to address an imminent security or infrastructure threat.

6.4

Web Host Pro provides support based on the customer's active products and services, as well as adherence to appropriate communication standards. To ensure efficient service, customers should avoid submitting multiple tickets for the same issue, using threatening language, or requesting support for services that do not include live or ticket-based assistance (e.g., domain registration and domain transfers). If communication problems continue after a warning, we may consolidate or pause the affected support conversation until everyone can continue productively. This does not by itself end the customer's hosting service.

6.5

We may update these terms as our services or legal obligations change. Material updates will be posted here with a new revision date, and we will provide reasonable notice to affected customers when practical.

Backups and Data Retention

7.1

Web Host Pro maintains limited system level backups as a disaster recovery measure, not as a guaranteed data retention or archival service.

7.2

All web hosting accounts are backed up daily using automated local and remote backup systems. These backups are intended solely for emergency recovery purposes.

7.3

Virtual Private Server and Dedicated Server backups are not enabled or scheduled by default. Due to privacy, security, and compliance requirements, Web Host Pro does not copy or access customer data on these services without explicit authorization. Customers must contact support to request backups and approve the backup schedule before configuration. Backup availability and cost depend on storage and system capacity.

7.4

Routine backups do not include most email data, cache directories, trash folders, temporary files, on site backup archives, or other non essential or high churn data. Backup contents are optimized for system recovery and performance, not full account mirroring.

7.5

In the event of a full server upgrade or system migration initiated by Web Host Pro, all files and email data are included as part of that process.

7.6

Backups are maintained strictly for use in the event of a server failure or system becoming nonfunctional, requiring restoration from remote backup storage. Such events are extremely rare, but backups are maintained as a necessary safety measure in the event of disaster. Backups are not intended for routine restores, individual file recovery, or as a substitute for customer managed backups.

7.7

Customers are strongly encouraged to maintain their own independent backups of all critical data.

Security Compromise and Malware Response

If we confirm or reasonably determine that an account has been compromised, infected, or is otherwise creating a risk to server stability, network reputation, other customers, or data integrity, HudsonHost and Web Host Pro will contact the customer and work toward a solution. If an active compromise presents an imminent risk, we may temporarily isolate or restrict only the affected service while notifying the customer as promptly as practical.

We may preserve existing backups, snapshots, or other recovery points when necessary to prevent known-good copies from being overwritten or contaminated.

When practical, we may attempt limited malware cleanup if the compromise is confined to identifiable malicious files and the likely entry point can be reasonably determined. Cleanup may include removing malicious files, disabling compromised scripts, resetting permissions, or taking similar actions necessary to secure the account.

We may discontinue cleanup efforts and require restoration from a known-good backup when the compromise is extensive or cannot be reliably remediated. This may include situations involving numerous modified core files, unknown persistence mechanisms, database injections, unauthorized administrator accounts, repeated reinfection, widespread file modification, or other conditions that make cleanup unreliable or likely to leave the account compromised.

Restoration from backup, deletion of substantial customer data, or other significant modification of website content will normally require customer approval. However, we may take narrowly tailored urgent action when reasonably necessary to stop active abuse, prevent further compromise, protect infrastructure or other customers, or preserve network and server integrity. We will communicate what was done and work with the customer on restoration.

Malware cleanup and recovery are provided on a reasonable-effort basis and do not guarantee that all malicious code, unauthorized changes, vulnerabilities, or persistence mechanisms will be identified or removed. Customers remain responsible for maintaining secure applications, credentials, plugins, themes, scripts, and other software within their hosting account.
